1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Epic Progress for Confluence ("the App"), developed by Janek Behrens ("we", "us", "our"). By installing or using the App, you agree to these Terms. The App is distributed exclusively through the Atlassian Marketplace, and your use is also subject to the Atlassian Marketplace Terms of Use.

Subject to these Terms and your active subscription (where applicable), we grant you a non-exclusive, non-transferable, revocable license to install and use the App within your Atlassian Confluence Cloud site, and with Jira on the same site, for your internal business purposes.

The App reads your data within the Atlassian platform with the permissions of the person using it and has no write access to Jira or Confluence. Our handling of data is described in our Privacy Policy and Security Policy, which form part of these Terms.

6. Published Snapshots

A published snapshot shows data that the publishing person could see in Jira to everyone who can see the page, including people without Jira access. Publishing a snapshot is a deliberate action of that person, who is responsible for sharing the data with the readers of the page, as if they had copied it into the page. Your Confluence admins can turn snapshots off for your site.

7. Service Availability

The App runs on Atlassian's Forge platform. Availability therefore depends on Atlassian's infrastructure. We do not guarantee uninterrupted or error-free operation and are not liable for downtime, maintenance, or changes to the underlying Atlassian platform.

8. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Progress figures are informational aggregates of the data in your Jira and Confluence site; a published snapshot shows the state at the time it was published. They should not be the sole basis for staffing, performance, or other critical decisions.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the App. Our total aggregate liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

10. Modifications to the App and Terms

We may update, modify, or discontinue features of the App at any time. We may revise these Terms; changes are reflected in the "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms.

11. Termination

You may stop using the App at any time by uninstalling it; Atlassian keeps the App's stored data for 28 days after the uninstall and then deletes it under its retention rules. We may suspend or terminate access for breach of these Terms or as required by Atlassian's Marketplace policies.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict-of-laws provisions, unless mandatory consumer-protection laws of your country of residence apply.
