Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Velocity Chart for Jira ("the App"), developed by Janek Behrens ("we", "us", "our"). By installing or using the App, you agree to these Terms. The App is distributed exclusively through the Atlassian Marketplace, and your use is also subject to the Atlassian Marketplace Terms of Use.

2. License

Subject to these Terms and your active subscription (where applicable), we grant you a non-exclusive, non-transferable, revocable license to install and use the App within your Atlassian Jira Cloud instance for your internal business purposes.

3. Subscriptions, Billing & Free Tier

• Billing, pricing, invoicing, and payment are handled entirely by Atlassian through the Marketplace. We do not process payments or store payment information.
• The App offers a free tier with core functionality; additional ("Pro") features are enabled for licensed instances per the pricing shown on the Marketplace listing.
• Pricing tiers and billing terms are as displayed on the Atlassian Marketplace and governed by Atlassian's billing policies.

4. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code except as permitted by applicable law or the App's open-source license.
• Use the App to violate any law or any third party's rights.
• Resell, sublicense, or redistribute the App outside the terms of its license.
• Attempt to disrupt or compromise the integrity or security of the App or the Atlassian platform.

5. Data & Privacy

The App is read-only and processes your data within the Atlassian platform. Our handling of data is described in our Privacy Policy and Security Policy, which form part of these Terms.

6. Service Availability

The App runs on Atlassian's Forge platform. Availability therefore depends on Atlassian's infrastructure. We do not guarantee uninterrupted or error-free operation and are not liable for downtime, maintenance, or changes to the underlying Atlassian platform.

7. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Velocity figures are informational estimates derived from your Jira data and should not be the sole basis for critical decisions.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the App. Our total aggregate liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Modifications to the App and Terms

We may update, modify, or discontinue features of the App at any time. We may revise these Terms; changes are reflected in the "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms.

10. Termination

You may stop using the App at any time by uninstalling it, which removes all App-stored data from Forge Storage. We may suspend or terminate access for breach of these Terms or as required by Atlassian's Marketplace policies.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict-of-laws provisions, unless mandatory consumer-protection laws of your country of residence apply.
