Terms of Service

1. Agreement

By installing or using Visual Progress Tracker ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not install or use the App. These Terms apply in addition to the Atlassian Marketplace Terms of Use and the Atlassian Customer Agreement.

2. Description of the App

Visual Progress Tracker is a Jira Cloud app that adds customizable progress bar fields to Jira issues. The App provides:

• Three custom field types: Manual, Status-based, and Subtask-based progress bars.
• A dashboard gadget for project-wide progress overview.
• An admin configuration page for status mappings and color thresholds.

3. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App on your Atlassian Jira Cloud instance in accordance with your Atlassian Marketplace subscription.

4. Acceptable Use

You agree to:

• Use the App only for its intended purpose within Jira Cloud.
• Not reverse-engineer, decompile, or attempt to extract the source code of the App.
• Not use the App in any way that violates applicable laws or Atlassian's terms.

5. Availability and Support

• The App is provided on an "as available" basis. We aim for high availability but do not guarantee uninterrupted service.
• The App runs on the Atlassian Forge platform; its availability depends on Atlassian's infrastructure.
• Support is available Monday – Sunday, including holidays. Support requests can be sent to support@janekbehrens.de. We aim to respond within 24 hours. For critical issues, include "URGENT" in the subject line.

6. Data and Privacy

Our handling of data is described in our Privacy Policy. In summary:

• The App processes Jira issue data solely to calculate and display progress.
• All data stays within the Atlassian platform. No data is sent to external servers.
• Configuration data is stored in Atlassian Forge Storage and is deleted when the App is uninstalled.

7. Intellectual Property

The App, including its code, design, and documentation, is the intellectual property of Janek Behrens. Your license to use the App does not transfer any ownership rights.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, secure, or uninterrupted.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Janek Behrens be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the App, regardless of the theory of liability.

Our total liability for any claim arising from or related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

10. Termination

• You may stop using the App at any time by uninstalling it from your Jira instance.
• We may discontinue or modify the App at any time. We will provide reasonable notice for significant changes.
• Upon termination, your license to use the App ceases, and all App-related data in Forge Storage is deleted.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts in Germany.
